Jury Trials On The Rise Across Ontario

Jury trials and MVA trials are on the rise across Ontario.

Here are some highlights:

  • Increase in trials overall
    • Last year, there were 2,740 trials in Superior Court
    • 5 years ago, there were 2,387 trials in Superior Court
  • Increase in Jury trials
    • Last year, 54% of all Superior Court trials were Jury trials
    • 5 years ago, 49% of all Superior Court trials were Jury trials
  • Increase in MVA trials
    • Last year, motor vehicle accident trials accounted for 49% of all Superior Court trials
    • 5 years ago, motor vehicle accident trials accounted for 44% of all Superior Court trials
    • 85% of motor vehicle accident trials have a Jury (based on the last 5 years)
    • 60% of motor vehicle accident trials under the simplified procedure have a Jury (based on the last 5 years)
  • Medical malpractice
    • 32% of medical malpractice trials have a Jury (based on the last 5 years)
  • Other personal injury (such as slip and falls)
    • 60% of other personal injury trials have a Jury (based on the last 5 years)

Looking ahead, with MVA trials dominating the Superior Court, it will be interesting to see how the LAT impacts MVA trial numbers.  This is dependent on how many plaintiffs opted to go to Court instead of arbitration.
